The rule: Safer from Wildfires
In 2022 the California Department of Insurance adopted the Safer from Wildfires regulation (10 CCR §2644.9). It requires every admitted insurer that uses wildfire risk in rating to recognize specific mitigation actions with premium discounts, disclose your property's wildfire risk score, and give you a way to appeal it. Carriers submitted their discount programs to the Department in April 2023. The discounts are real and enforceable. They are applied when you submit acceptable proof.
What the discounts are worth
Discount amounts vary by carrier and by how much of the framework you complete:
- The California FAIR Plan has filed home-hardening discounts of up to 24.5%.
- Major admitted carriers have filed mitigation discounts commonly in the 5–20% range. CSAA files wildfire discounts of up to 15% for hardening plus up to 5% for community-level mitigation, and Mercury files tiered structure-and-community discounts.
- Community measures stack: a Firewise USA site or Fire Risk Reduction Community listing earns an additional filed credit at most carriers.
On a $3,000 wildfire-zone premium, a mid-range 12% mitigation discount is $360 every year. The evidence packet that claims it is $49, once.
The qualifying actions
Safer from Wildfires defines a specific list of structure hardening plus community participation:
- Class A fire-rated roof
- Ember-resistant vents (flame- and ember-resistant)
- Noncombustible zone in the first five feet (Zone 0)
- Defensible space compliance to 100 feet (PRC §4291)
- Cleared gutters, roof debris, and under-deck areas
- Multi-pane windows and fire-resistant exterior doors
- Enclosed eaves and noncombustible siding upgrades
- Trimmed trees and removed ladder fuels near the structure
- Firewise USA or Fire Risk Reduction Community membership
What proof carriers accept
This is where discount requests die. Carriers and the FAIR Plan verify claims with photos, invoices, inspection reports, and certifications, each with its own requirements. A vent discount needs the label legible in the photo. A roof discount needs the material class on an invoice or spec sheet. Defensible space needs every zone photographed from every side.
